1. Regulatory Status and Licensing
CITYTRUST LIMITED (the "Company") is a trust company registered under the Trustee Ordinance (Cap. 29, Laws of Hong Kong) and holds a Trust or Company Service Provider (TCSP) licence issued by the Hong Kong Companies Registry (Licence No. TC010153).
The Company is not licensed or registered with the Hong Kong Securities and Futures Commission (SFC) to carry on any regulated activity, and is not an authorised institution or stored-value facility licensee regulated by the Hong Kong Monetary Authority (HKMA).
2. Trustee and Execution Only (No Investment Advice)
Nothing on this Website or the Platform constitutes, or should be construed as, an offer, solicitation or recommendation to buy or sell any securities, virtual assets, financial products or instruments.
The Company does not provide investment, legal, tax or financial advice of any kind. Before making any investment decision you should independently assess the risks and consult licensed professional advisers.
3. Third-party Services and Instruction Execution
All investment products available through the Platform (including but not limited to equities, funds and virtual currencies) and payment services (such as debit/credit card functions) are provided by independent third-party service providers holding the relevant statutory qualifications.
In every transaction the Company acts solely as a passive trustee, holding assets strictly in accordance with the client's absolute instructions and routing execution instructions to the relevant third-party institutions. The Company does not create, issue, actively manage or underwrite any financial product.
4. Risk Disclosure and Limitation of Liability
The Company gives no warranty as to the service quality, product performance, system stability or credit standing of any third-party provider. The following risks (among others) are borne solely by you:
- price volatility of investment products and the risk of loss of principal;
- counterparty default risk;
- risks relating to virtual-asset networks (including cyber-attacks, forks and protocol changes);
- risks relating to third-party payment gateways.
The Company accepts no liability for any direct or indirect loss arising from your instructions, your reliance on information displayed on the Platform, or your use of third-party services.
Technical and system execution risk: the Company accepts no liability for losses caused by network latency, hacking, system failure or API malfunction that prevents your instructions from reaching third-party institutions in a timely manner.
Accuracy of third-party information: quotations, net asset values and market data displayed on the Platform are provided by third parties; the Company is not responsible for delays, omissions or errors. Such information is for reference only and does not form the basis of any transaction.
5. Segregation of Assets
Fiat currencies and other assets you place with the Company are held independently as trust assets under the trust deed, strictly segregated from the Company's own funds.
Digital assets are likewise held in the trustee’s name under segregated custody arrangements (client-level segregated vaults, including the appointment of qualified custodians and the use of institutional-grade custody technology), held and recorded separately from the Company’s own assets; the specific custody arrangements shall be as disclosed by the Company from time to time.
Important note: such trust assets are not protected by the Hong Kong Deposit Protection Scheme (DPS) or the Investor Compensation Fund (ICF).
